Terms and Conditions APAL PRODUCTS LTD

These terms and conditions (“Terms”, “Agreement”) are an agreement between APAL PRODUCTS LTD (“APAL Products”, “www.apalproducts.co.uk”  “us”, “we” or “our”) and you (“User”, “you” or “your”). This Agreement sets forth the general terms and conditions of your use of the https://apalproducts.co.uk website and any of its products or services (collectively, “Website” or “Services”).

We reserve the right to request evidence of age before fulfilling any orders on some items.

  • 1. Products
    • 1.1 Products may slightly vary from their pictures. Product images are for illustrative purposes only. Although we attempt to make every effort to make images on our site reflect our products, we cannot guarantee that your device’s display reflects the actual colour of the products. Your product may vary slightly from those images.
    • 1.2 Products may differ from one item to another. Due to variations in manufacturing, we cannot guarantee that one item will be the same as the next.
    • 1.3 The packaging of our products may vary from time to time. You may not return a product because of the way it is packaged as the packaging does no way reflect the product itself.
    • 1.4 If you wish to make any changes to any orders that you have placed, please contact us with your given order number.
  • 2. Accounts and Membership
    • 2.1 If you create an account on the Website, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it.
    • 2.2 Providing false contact information of any kind may result in the termination of your account. You must immediately notify us of any unauthorised uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill.
    • 2.3 If we delete your account for the foregoing reasons, you may not re-register for our Services. We may block your email address and Internet protocol address to prevent further registration.
  • 3. Billing and payments
    • 3.1 You shall pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable.
    • 3.2 We will not dispatch orders until payments have been received. We will send you conformation once the order and payment has been accepted.
    • 3.3 If, in our judgment, your purchase constitutes a high-risk transaction, we will require you to provide us with a copy of your valid government-issued photo identification, and possibly a copy of a recent bank statement for the credit or debit card used for the purchase.
    • We reserve the right to change products and product pricing at any time.
    • We also reserve the right to refuse any order you place with us.
    • We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.
    • In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.
  • 4. Delivery
    • 4.1 Delivery costs are displayed on our website or quotes are provided where they are not displayed. 
    • 4.2 Delivery of goods shall take place at the address specified by you. Unless otherwise agreed. You must make all arrangements necessary in order to receive the delivery of goods.
    • 4.3 We aim to dispatch orders as soon as possible. Orders received before 12pm will be sent on the same working day (or next working day if ordered on the weekend). Once your order is accepted we will make every effort to dispatch the goods. Once goods are dispatched, you cannot cancel your order.
    • 4.4 We will make all efforts to meet delivery commitments specified on our site. All delivery times and dates given by us are estimates, we hope to get your orders to you as soon as possible. We cannot be held liable for any loss or damages caused as a result of delivery as we do not deliver the products and it is out of our control.
    • 4.5 If a delivery is missed, the courier will make efforts to deliver the product to you. If the item is not able to be posted through your letterbox, a delivery note may be posted in order to rearrange the delivery or alternatively products may be delivered to a neighbour and a note will be left for you.
    • 4.6 Any damages, shortages, duplicated orders and over deliveries must be reported to our customer service support team at info@apalproducts.co.uk within 14 days of order conformation to enable replacement or refund.
    • 4.7 We currently only trade online in the UK. We do not accept orders outside of the UK. For more information please contact our support team at info@apalproducts.co.uk.
    • 4.8 Free delivery is available for orders over £30 in England, Wales and some Scotland locations. We may refuse orders outside of England and Wales due to postage costs. However we will provide customers with a new quote before cancelling the order. 
    • 4.9 Next day delivery is provided for all customer in England and Wales, provided by DHL UK. Orders must be placed before 2pm.
    • We cannot guarantee that the order will be received the next day as services are not provided by us, however most orders do receive our customers next day. 
    • 4.10 For areas excluding England and Wales, please allow 2-3 working days for delivery. 
    • 4.11 Depending on location we may request additional delivery charges that have not been calculated by our website. 
  • 5. Returns and Cancellations
    • 5.1 We offer a 14 day product return policy. The item must be unused, factory sealed and unopened. Due to the nature of our products, we are unable to accept any items that have been opened/used.
    • 5.2 If the products that you receive have suffered extensive damage or are unfit for purpose, please contact our customer service team.
    • 5.3 You have the right to cancel your order until the point of dispatch. Please email our team at info@apalproducts.co.uk to cancel your order.
    • 5.4 Orders cannot be cancelled once the delivery has been made.
    • 5.5 Returns must be sent to Unit 7, 8 & 10 New Railway Street, Willenhall, West Midland. WV13 1LJ. Please ensure that you have noted your order number/printed a returns receipt before returning.
    • 5.6 We cannot refund the delivery costs that you may incur when returning goods.
  • 6. Limitation of Liability
    • 6.1 Our maximum liability to you is to the replacement value of the product. We do not accept liability for: any losses that are not caused by any breaches on our behalf, business or trade losses, damage to goods (via transit).
    • 6.2 All issues must be reported to our customer service team. Please email us on info@apalproducts.co.uk.
  • 7. Guarantee and Warrantee
    • 7.1 Our products are not covered by any warranty. We will not accept any returns if the product is opened or used.
    • 7.2 If an item is received and is incorrect, please get in contact with our customer service team who will be able to deal with your issues to the best of their ability.
    • 7.3 We do not offer any warranties.
    • 7.4 If a refund has been granted for any reason, please allow 30 days for the sums to be paid into your account.
    • 7.5 You have 14 days to submit a claim after delivery.
    • 7.6 Misuse of the product leading to damage is not covered by these terms.
  • 8. User content
    • 8.1 We do not own any data, information or material (“Content”) that you submit on the Website in the course of using the Service. You shall have sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all submitted Content.
    • 8.2 We may, but have no obligation to monitor Content on the Website submitted or created using our Services by you. Unless specifically permitted by you, your use of the Website does not grant us the license to use, reproduce, adapt, modify, publish or distribute the Content created by you or stored in your user account for commercial, marketing or any similar purpose. But you grant us permission to access, copy, distribute, store, transmit, reformat, display and perform the Content of your user account solely as required for the purpose of providing the Services to you. Without limiting any of those representations or warranties, we have the right, though not the obligation, to, in our own sole discretion, refuse or remove any Content that, in our reasonable opinion, violates any of our policies or is in any way harmful or objectionable.

    • 9.1 Occasionally there may be information on the Website that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, product shipping charges, availability, promotions and offers. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the Website or on any related Service is inaccurate at any time without prior notice (including after you have submitted your order).
    • 9.2 We undertake no obligation to update, amend or clarify information on the Website including, without limitation, pricing information, except as required by law. No specified update or refresh date applied on the Website should be taken to indicate that all information on the Website or on any related Service has been modified or updated.

    • 10.1 We perform regular backups of the Website and Content and will do our best to ensure completeness and accuracy of these backups. In the event of the hardware failure or data loss we will restore backups automatically to minimise the impact and downtime.

    • 11.1 Although this Website may be linked to other websites, we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked website, unless specifically stated herein.
    • 11.2 We are not responsible for examining or evaluating, and we do not warrant the offerings of, any businesses or individuals or the content of their websites. We do not assume any responsibility or liability for the actions, products, services and content of any other third parties. You should carefully review the legal statements and other conditions of use of any website which you access through a link from this Website. Your linking to any other off-site websites is at your own risk.
